Introduction

Welcome to Flexapoint ("we", "us", or "our"). Flexapoint is a digital loyalty and rewards feature operated by Flexagift that enables users to manage their Flexa Coupons, accumulate points, and redeem them for digital vouchers from various merchants and brands.

By accessing or using our website, mobile application, or related services (collectively referred to as the "Services"), you agree to comply with and be bound by these Terms and Conditions ("Terms"). Please read them carefully before using our Services.

Definitions

• User / Member: Any individual or entity registered on the platform who holds Flexa Coupons and uses Flexapoints.
• Flexa Coupon: A digital coupon issued to users that holds a specific monetary value and possesses a strict expiration date.
• Flexapoint (Points): The reward points accumulated by a user, converted from active Flexa Coupons.
• Voucher / E-Voucher: A digital code or coupon redeemed through the platform using Flexapoints, or a combination of Flexapoints and an authorized monetary payment method, which can be used for goods or services from partner merchants.
• Merchant / Partner: Third-party brands or vendors that accept or provide vouchers distributed by Flexapoint.
• Account: An account registered by a user to access the Services.
• Personal Data: Any information relating to an identified or identifiable natural person, processed in accordance with our Privacy Policy.
• Payment Gateway: The third-party service provider authorized to process monetary payments.
• Applicable Laws: Any and all laws, regulations, or decrees of the Republic of Indonesia.
• Flexapoint does not constitute electronic money, stored value, securities, or any legal tender.

Use of Services & Point Accumulation

1. Point Conversion and Accumulation

• Users can accumulate Flexapoints by saving or linking their Flexa Coupons to their account.
• The conversion rate from Coupon Value to Flexapoints is 1:1 (e.g., IDR 1,000 value from a coupon equals 1,000 Flexapoints).
• Your total Flexapoints balance is the accumulated total of all your active coupons, unexpired Flexa Coupons.

2. Coupon Expiration & Balance Adjustments

• Each Flexa Coupon has its own specific expiration date.
• If a Flexa Coupon expires before it is redeemed, the points associated with that specific coupon will be automatically deducted from your total Flexapoint balance.
• Expired points cannot be reinstated, refunded, or extended under any circumstances, unless otherwise required by applicable laws.

Voucher Redemption Flow

When redeeming your Flexapoints for digital merchant vouchers, the following rules apply:

• Hybrid Payment: In the event your Flexapoint balance is insufficient to cover the total cost of a digital voucher, you may supplement the remaining balance using an authorized third-party payment method available on the platform. Flexapoints will be prioritized and deducted first, followed by the payment of the remaining amount.
• First-to-Expire Priority: To help you protect your rewards from expiring, our system automatically prioritizes your points. Points retrieved from coupons with the nearest expiration date will always be used first during any redemption.
• Finality of Redemption: Once Flexapoints are redeemed for a digital voucher (including any hybrid payment made), the transaction is final. The points used cannot be reversed back into coupons, and the voucher cannot be refunded, exchanged, or cancelled.
• Voucher Validity: The digital merchant vouchers obtained via redemption have their own separate validity periods and usage terms, which are clearly stated on the product details page. Flexapoint is not responsible for expired merchant vouchers.
• Merchant Limitations: Each voucher is subject to the individual terms of the respective partner merchant. We are not responsible for merchant-side issues, including product quality, stock availability, or service refusal.
• Disclaimers and Service Disruptions: Flexapoint reserves the right to void, cancel, or correct transactions, including vouchers, in the event of technical failure, error pricing, force majeure, duplicate transactions, or merchant-side product discontinuation.

Privacy & Consent

Personal Data is processed in accordance with our Privacy Policy. By clicking 'Agree' or using the Services, you acknowledge that this constitutes a valid electronic agreement under the Law on Information and Electronic Transactions (UU ITE) and the Government Regulation on the Provision of Electronic Systems and Transactions (PP PSTE).

Intellectual Property

All intellectual property rights (HAKI) related to the platform, software, trademarks, and content are the exclusive property of Flexagift.

Suspension & Termination

We reserve the right to suspend or terminate your account at any time for violations of these Terms, fraudulent activity, or prolonged inactivity.

Taxes

Any applicable taxes arising from the redemption of vouchers shall be the responsibility of the user or merchant as required by law.

User Obligations and Prohibited Activities

Users agree not to:

• Engage in fraudulent activities, such as exploiting system bugs or manipulating coupon data to generate unauthorized points;
• Resell, trade, or commercially redistribute Flexapoints or redeemed vouchers;
• Attempt to gain unauthorized access to other users' accounts or point balances.
• Use of unauthorized, stolen, or fraudulent payment methods to supplement Flexapoint redemptions.

⚠️ Account Protection: Flexapoint reserves the right to freeze accounts, deduct points, or cancel redeemed vouchers if we suspect any fraudulent activity, system manipulation, or violation of these Terms.

Limitation of Liability

• Flexapoint acts as a platform provider facilitating the conversion and redemption of rewards.
• We shall not be held liable for any losses resulting from user negligence, including failing to track coupon expiration dates or entering incorrect recipient information provided, however, that this limitation shall not apply to liabilities arising from fraud, gross negligence, willful misconduct, breach of law, or personal data breaches.
• To the maximum extent permitted by law, Flexapoint's total liability shall not exceed the point or monetary value of the affected coupon/voucher in dispute.
• Flexapoint is not liable for service interruptions, errors, or financial disputes arising from the use of third-party payment gateways during hybrid redemption transactions.

Governing Law and Dispute Resolution

These Terms and Conditions are governed by and interpreted in accordance with the laws of the Republic of Indonesia.

Any disputes shall first be resolved amicably. If unresolved, the dispute shall be submitted to the jurisdiction of the District Court of South Jakarta (Pengadilan Negeri Jakarta Selatan).

Amendments

Flexapoint may modify these Terms at any time. We will provide reasonable notice to users regarding any material changes to these Terms via our platform. Updated versions will be published on our platform with a new effective date. Your continued accumulation or redemption of points after any changes constitutes acceptance of the revised Terms.

Welcome to Flexapoint ("Flexapoint", "we", "our", or "us"). Flexapoint is an online platform operated by PT Flexagift, providing digital gifting, coupon management, and point reward services. Our platform allows users to accumulate points from Flexa coupons, manage point balances, and redeem points for digital vouchers from our merchant partners.

Roles

Under the Indonesian Personal Data Protection Law (UU PDP), Flexapoint acts as the Personal Data Controller (Pengendali Data Pribadi) responsible for processing, and our service providers act as Data Processors (Prosesor Data Pribadi).

We value your trust and are committed to protecting your personal data in accordance with Indonesia’s Personal Data Protection Law No. 27 of 2022 ("PDP Law") and applicable regulations issued by the Ministry of Communication and Informatics (Kominfo).

By accessing or using our website, mobile application, or related services (collectively, the "Services"), you acknowledge that you have read and understood this Privacy Policy and consent to the collection, use, and disclosure of your personal data as described below.

Personal Data We Collect

We collect personal data directly from you and through your interactions with our Services. The types of data we may collect include:

Personal Identification & Account Security Data

• Full name

• Mobile number or WhatsApp ID (for voucher delivery, notifications, and account verification)
• Security Credentials: A user-created 6-digit security PIN used exclusively to authorize and authenticate point redemption transactions.

Transaction, Coupon & Point Data

• Flexapoint Balance: Records of your total accumulated points converted from your Flexa coupons.
• Coupon Ledger: Details of your registered Flexa coupons, including their specific expiration dates and nominal values in Indonesian Rupiah (IDR).
• Redemption & Purchase History: Records of points converted into digital vouchers, transaction values, timestamps, and details of the specific expiring coupons utilized.

Technical & Usage Data

• IP address, browser type, and device information
• Access logs, website usage patterns, and cookies
• Referral links and session duration

Communication Data

• Messages or inquiries sent to our customer service team
• Feedback, ratings, or reviews submitted through our platform

Payment Transaction Data

• Transaction Records: Details regarding the monetary portion of your transactions, including payment status, transaction IDs, and currency.
• Payment Method Information: We collect limited data necessary for transaction processing (such as payment method type). Note: We do not store full credit/debit card numbers or CVV codes, as these are securely handled directly by our PCI-DSS compliant payment gateway partners.

We do not store full credit or debit card details, nor do we store your 6-digit security PIN in plain text. All financial and security information is encrypted and processed by trusted partners or secure systems that comply with industry-standard security measures.

Legal Basis for Processing Personal Data

Our processing of your personal data is conducted on the following legal bases: (i) your explicit consent; (ii) the necessity to fulfill our contractual obligations to you; (iii) compliance with our legal obligations; and (iv) other legitimate interests permitted under the PDP Law.

How We Use Your Personal Data

We use your personal data only for legitimate business purposes permitted under the PDP Law, including to:

• Manage Point Accumulation: Convert your eligible Flexa coupons into Flexapoints at a 1:1 ratio (where 1 IDR nominal value equals 1 Flexapoint) and maintain your total accumulated point balance.
• Optimize Smart Redemption: Track coupon expiry dates and automatically prioritize the deduction of points from coupons with the nearest expiration date when you perform a point redemption.
• Secure Transactions: Verify and validate your 6-digit security PIN to authorize point redemptions, ensure authenticity, prevent fraud, and handle voucher issues with our merchant partners.
• Provide and operate our Services, process orders, issue digital vouchers, and deliver them via email, WhatsApp, or SMS.
• Communicate with you, send redemption confirmations, respond to support inquiries, and provide updates.
• Improve our platform, analyze usage data to enhance functionality, user experience, and security.
• Send marketing communications; with your explicit consent, we may send you promotional offers, news, and surveys. You can opt out at any time.
• Process Hybrid Transactions: Facilitate the payment of the remaining balance when your Flexapoint balance is insufficient to redeem a voucher. This includes coordinating with third-party payment gateways to confirm successful transactions and issuing your digital vouchers.
• Comply with legal obligations, respond to lawful requests, audits, or regulatory requirements.

Sharing and Disclosure of Personal Data

We do not sell or rent your personal data. However, we may share it with third parties in the following limited circumstances:

Service Providers

We engage third-party vendors (such as hosting providers, communication gateways for SMS/WhatsApp, payment processors, and analytics services) to help operate our business. These parties are contractually required to protect your data and use it only for the purposes we specify.

Merchant & Voucher Partners

To process and fulfill voucher redemptions (including those involving a hybrid payment), we may share necessary order information—such as transaction ID, order status, and payment confirmation status—with our merchant partners and payment service providers to ensure your voucher is issued correctly.

Business Transfers

If Flexapoint is involved in a merger, acquisition, or asset transfer, your data may be transferred as part of that transaction. We will notify users before any material change in ownership or data use occurs.

Legal Obligations

We may disclose your information if required by law or in good faith to protect our rights, property, or safety, or that of users and the public.

Data Retention

We retain personal data only for as long as necessary to fulfill the purposes outlined in this privacy policy or to comply with applicable legal and accounting obligations.

Afterward, we will securely delete or anonymize your data. If you close your account, transactional data, coupon redemption logs, and historical point ledgers may still be retained for legal or audit purposes for up to 5 (five) years or longer as required under applicable Indonesian laws and regulations.

Data Security

We employ administrative, technical, and physical safeguards to protect your personal data from loss, misuse, unauthorized access, or disclosure. These include end-to-end encryption, secure servers, limited employee access, and regular system audits.

To maintain the highest level of security, we do not store, process, or have access to your full credit card or bank account details. All monetary transactions are processed through secure, PCI-DSS compliant third-party payment gateways. These partners are responsible for the secure handling of your financial information in accordance with their own privacy policies.

While we take rigorous measures, no system is entirely secure, and we cannot guarantee absolute protection. If a personal data breach occurs, we will notify affected users and Kominfo within 3x24 hours as required by the PDP Law.

Please note that we may implement enhanced identity verification (KYC) mechanisms in the future to ensure account security and regulatory compliance.

Your Rights as a Data Subject

Under Indonesia’s PDP Law, you have the following rights regarding your personal data:

• Right to Information - to be informed about how your data is processed.
• Right to Access - to request a copy of your personal data held by us, including your coupon and point transaction history.
• Right to Correction - to request rectification of inaccurate or incomplete data.
• Right to Deletion - to request deletion of your data or account when no longer necessary.
• Right to Withdraw Consent - to revoke your consent to processing activities.
• Right to Object - to object to data processing for certain purposes.
• Right to Data Portability - to receive your personal data in a structured, machine-readable format.
• Right to File a Complaint - to lodge a complaint with Kominfo if you believe your data has been mishandled.

Flexapoint uses cookies and similar technologies to improve our Services, analyze website traffic, and personalize content.

• Analytics Cookies - help us understand usage patterns to enhance performance.
• Marketing Cookies - used (with your consent) to deliver relevant ads and promotions.

You may manage cookie preferences through your browser settings. Please note that disabling cookies may affect site performance and your ability to smoothly access certain features of the platform.

International Data Transfers

Flexapoint may store or process personal data on servers located outside Indonesia. We will only transfer data internationally when:

1. The destination country provides an adequate level of data protection that meets or exceeds the standards of the PDP Law, or
2. Appropriate safeguards (such as standard contractual data protection clauses) are strictly in place.

Children’s Privacy

Our Services are not intended for individuals under the age of 18. We do not knowingly collect personal data from minors. If we discover that a minor has provided data without parental consent, we will promptly delete such information and, if applicable, suspend the related account.

Updates to This Policy

We may update this Privacy Policy from time to time to reflect changes in our Services, system features, or evolving regulations under the PDP Law. Any changes will be posted on our platform with an updated effective date. If changes are material, we will notify users via email or a prominent notification within the application before they take effect.

Force Majeure

Flexapoint shall not be held liable for any failure or delay in performing our services due to causes beyond our reasonable control, including but not limited to natural disasters, war, civil unrest, pandemics, or government-imposed restrictions.
